Abstract: In order to clarify the current situation of the protection of new varieties of Phalaenopsis plants, understand deeply the problems the problems existing in the protection of new varieties of Phalaenopsis plants and make recommendations, by sorting out the information on the application and authorization of new plant varieties released by the Big Data Platform of China's Seed Industry and the Science and Technology Development Centre of the Ministry of Agriculture and Rural Affairs, the number of the varieties of Phalaenopsis plants that have been applied for or authorized, and the time when they were applied for or authorized were counted, and the current situation of the protection of new varieties of Phalaenopsis plants was analyzed from the three aspects, different years, different subjects and different regions. The results showed that: the protection list of 11 batches of new plant varieties included 43 genera (species) of ornamental plants, among which the number of applications of Phalaenopsis plants has jumped to the first. By the end of 2022, there were 1 116 Phalaenopsis varieties that received the applications, and 361 Phalaenopsis species have been authorized, and the average time length of examination for the authorized varieties was 3.00 years. A total of 90 units or individuals have submitted the applications for the protection of new varieties of Phalaenopsis plants as the subject of applications, among which the enterprises were the main body of applicants and variety right holders, and the proportion of application quantity from the enterprises, scientific research institutes, colleges and universities and individuals were 79.7%, 11.8% , 0.8% and 7.7%, respectively. A total of 47 units or individuals have obtained the authorization of new varieties of Phalaenopsis as the variety right holders, among which, the enterprises, scientific research institutes, colleges and universities and individuals accounted for 73.7%, 10.5%, 1.4% and 14.4% of the authorization quantity, respectively. 14 provinces in China and two foreign countries (the Netherlands and Japan) have applied for the protection of new varieties of Phalaenopsis plants in China, and spatially the applicants and variety right holders were mainly concentrated in the southeastern coast of China as well as in the Netherlands, while only Anthura Company of the Netherlands has been granted the authorization abroad.
